Public Law
At E Rex Makin & Co we have very significant
and pioneering experience in the field of human rights law (we have prepared and
presented cases before the European Court of Human Rights resulting in changes
to domestic law) and in the growth areas of data protection and freedom of information
involving issues for individuals and public bodies.
Public law (sometimes known as Administrative Law) concerns
the exercise of power by public bodies. Government; some courts and tribunals (such as
coroners’ courts); local authorities; universities, schools and other educational
institutions: the prison service: NHS Trusts: the Legal Services Commission; and many more
of various kinds that make decisions affecting citizens. The legality of those decisions
and the procedures that public bodies follow are matters with which we can help.
Complaints procedures and Ombudsman schemes
We can assist and advise with complaints to public bodies and in ombudsman investigations,
where necessary we can provide representation at hearings and enquiries.
Judicial Review
We advise about and act for Claimants, Defendants and Interested Parties in judicial review
proceedings in which challenges to decisions of public bodies are considered by a judge
in the Administrative Court.
Public Inquiries, Inquests and Tribunal Proceedings
We are able to advise and provide representation at Public Inquiries, Coroners’ Inquests and adjudicating
Tribunals. We can also advise and represent you at any appeal that may follow an initial decision.
Regulation and Licensing
We also deal with regulatory and licensing issues by public bodies.
